User Agreement & Terms of Service

Introduction:

Welcome to Jamilah Beauty. This agreement outlines the terms and conditions governing your use of this store and all legal effects resulting from your use of the store's services through this electronic platform. By using the store, whether as a consumer of a service or a product or otherwise, you acknowledge your full legal capacity and consent to all articles and provisions of this agreement. This agreement is effective upon your approval and start of registration under Article 10 of the Saudi Electronic Transactions System.

Article 1 - Introduction and Definitions:

The above preamble is an integral part of this agreement. Below are the key definitions:

  1. (The Store / Jamilah Beauty): Includes all forms of the store on the web, whether an electronic application, a website, or a commercial shop.
  2. (The Consumer): Any person who engages in electronic commerce to obtain products or services provided by the store.
  3. (The Agreement): The terms and conditions governing the relationship between the parties involved.

Article 2 - Legal Capacity:

  1. The consumer acknowledges they have the legal capacity to deal with the store or are at least eighteen (18) years of age.
  2. The consumer bears full responsibility for any breach of this article towards third parties.

Article 3 - Nature of Obligation:

  1. The store's primary obligation is to provide the requested (service or product).
  2. The store may provide related services such as after-sales support, depending on the nature of the product or service.

Article 4 - Terms of Use:

  1. The consumer is committed to using the store's platform in accordance with public morals and the laws of the Kingdom of Saudi Arabia.
  2. The consumer shall not use any purchased service or product in a manner that violates public morals or Saudi regulations.

Article 5 - Accounts and Registration Obligations:

Upon applying for membership, you are required to disclose specific information and choose a username and password. You agree to:

  1. Be responsible for maintaining the confidentiality of your account information and password.
  2. Notify the store immediately of any unauthorized use or security breach.
  3. The store is not liable for any direct or indirect loss resulting from the disclosure of your login credentials.
  4. Provide true, accurate, current, and complete information during registration.
  5. The store maintains the right to freeze or cancel membership if any provided information is found to be false or illegal.

Article 6 - Electronic Communications:

  1. Parties agree that communication will be conducted via the email registered on the platform.
  2. Electronic communications, agreements, and notices satisfy all legal requirements for written communication.

Article 7 - Amendments to Agreement and Fees:

  1. The store reserves the right to amend this agreement at any time. Remaining articles remain valid if one is invalidated.
  2. The store may impose fees on certain products or services, including taxes (VAT) as required by law.
  3. The store reserves the right to add, increase, or reduce any fees under this agreement.

Article 8 - Payment Services:

  1. The store provides a secure online payment system through its partners.
  2. The store is committed to providing invoices and receipts for all transactions.
  3. The store follows standard accounting practices to ensure legal and commercial integrity.

Article 9 - Intellectual Property:

  1. All intellectual property rights, including the store name, logos, and symbols, are the sole property of Jamilah Beauty.
  2. The consumer must respect these rights and is prohibited from using them without authorization.

Article 10 - Store Liability:

  1. The store operates in accordance with the laws of the Kingdom of Saudi Arabia.
  2. The store is not liable for claims arising from errors or negligence caused by the consumer or third parties (e.g., shipping companies).
  3. The store guarantees that its products/services are legitimate and authorized under Saudi law.

Article 11 - Restricting Access or Membership:

The store may suspend or cancel membership or restrict access to the platform at any time, for any reason, without prior notice.

Article 12 - Governing Law:

This agreement is governed by and construed in accordance with the laws and regulations of the Kingdom of Saudi Arabia.

Article 13 - General Provisions:

  1. The Arabic language is the primary language for interpreting this agreement.
  2. Prices and promotional offers are subject to change or cancellation at any time.
  3. Parties must deal with each other in accordance with Islamic Sharia and applicable laws.
  4. This agreement is only canceled by a decision issued by the management of the store.
